1. Scope
These terms of use apply to the use of this website and to communication with our Instagram accounts, which we manage with our software Echo Studio. The provider is Hey it's Sara, owner Sara Kammerlocher (full details in our legal notice).
Additional terms may apply to our apps and software, for example Dough it yourself, Cupcaker and Echo Studio. We point these out within the respective app or at the respective download.
2. Content and rights
The content of this website provides information about us and our products and does not constitute a binding offer. Features and availability of products that are still in development may change before release.
Texts, illustrations, logos and designs are protected by copyright. You may view them for private purposes and link to our pages. Any further use, in particular reproduction, adaptation or distribution, requires our prior consent unless permitted by law.
3. Offerings on platforms
We publish our 3D models on MakerWorld. Downloads and the use of the models are subject to MakerWorld's terms and to the licence stated for each model. Memberships to support our work are concluded and billed via Patreon, and Patreon's terms apply in addition. The use of Instagram is subject to Instagram's terms of use.
4. Automated messages on Instagram
If you comment on one of our Instagram posts with a specific keyword or reply to one of our stories, Echo Studio may reply to you automatically: publicly to your comment and/or with a direct message. The following applies:
- We only contact you after you have interacted with our account yourself.
- We only send the requested content, for example a link, after you have explicitly confirmed in the conversation that you want to receive it.
- You receive each automation only once.
- If you do not want any further messages, simply do not answer the confirmation question or write to us. We will then not send you any further automated messages.
There is no entitlement to a reply or to specific content. Our privacy policy explains how we handle your data in this context.
5. Code of conduct
Please treat us and others with respect in comments and messages. Unlawful, offensive, discriminatory or promotional content is not permitted. We reserve the right to remove such content, not to respond to it and to block accounts.
6. Availability and liability
We strive to provide this website and our services with as few interruptions as possible, but we cannot guarantee constant availability, for example during maintenance or outages of platforms such as Instagram.
We are liable without limitation for intent and gross negligence, for injury to life, body or health and under the German Product Liability Act. In the event of a slightly negligent breach of an essential obligation, the fulfilment of which makes proper use possible in the first place and on whose compliance you may regularly rely, our liability is limited to the foreseeable damage typical for this type of use. Otherwise, liability for slight negligence is excluded.
7. Final provisions
We may amend these terms of use with effect for the future, for example if our offerings or the legal situation change. The version published on this page applies.
These terms are governed by the laws of the Federal Republic of Germany. If you are a consumer with your habitual residence in another country, the protection afforded by the mandatory provisions of that country remains unaffected. Should individual provisions be invalid, the validity of the remaining provisions remains unaffected.
